Business Terms of Service

These terms govern the use of Zimun by businesses, owners, managers, staff members, and anyone managing appointments, customers, services, availability, or public booking pages through a business account.

1. Who these terms cover

Zimun provides a SaaS platform for appointment-based businesses. These terms apply to any business, owner, manager, staff member, administrator, or other authorized user who creates, accesses, or manages a business account on Zimun.

If you use Zimun on behalf of a business or organization, you confirm that you are authorized to bind that business to these terms and to manage the personal information, staff information, services, schedules, and customer records entered into the platform.

2. Account access and permitted use

  • You must provide accurate account, business, staff, service, pricing, availability, and contact information and keep it reasonably up to date.
  • You are responsible for all activity under your account, including actions taken by staff members, invited users, integrations, and anyone using your credentials.
  • You must protect login credentials, configure appropriate roles and permissions, and promptly remove access for people who should no longer use the business account.
  • You may not misuse the platform, interfere with its operation, attempt unauthorized access, scrape data, reverse engineer non-public functionality, bypass limits, or use Zimun for unlawful, deceptive, abusive, or spam activity.

3. Business responsibility for services and customers

  • The business is solely responsible for the actual services it offers, including descriptions, prices, durations, staff assignments, availability, cancellation rules, refunds, professional duties, permits, and customer communication.
  • Zimun provides scheduling infrastructure and does not provide, supervise, guarantee, or take responsibility for the service delivered by the business to its customers.
  • The business is responsible for ensuring that it has an appropriate legal basis and all required notices or consents for collecting and using customer information, including where the type of service may reveal sensitive information.
  • The business should avoid entering unnecessary sensitive information into free-text fields and should use short, professional wording where such information is required to operate the service.
  • If the business has its own customer terms, cancellation policy, consent language, or privacy notice, the business is responsible for presenting those materials to its customers where required.

4. Data protection, DPA, and subprocessors

  • The Privacy Policy explains when Zimun acts as a controller and when it processes business customer information on behalf of the business.
  • For business customer information entered, imported, or collected by a business, the business is usually the controller and Zimun acts as processor according to the business's settings and instructions.
  • Businesses that need a data processing agreement or additional privacy terms may contact privacy@zimun.app. Until a separate agreement is signed, these terms and the Privacy Policy govern the use of the platform.
  • Zimun may use subprocessors such as hosting, database, security, monitoring, email, SMS, IVR, identity, calendar, and support providers to operate the service. Subprocessors must process information only for the relevant service purpose and under confidentiality and security obligations.
  • The business is responsible for checking whether its own industry, location, or customer base requires additional notices, consents, agreements, or restrictions before using Zimun.
  • Authorized business owners may receive tools for deleting old appointment history. The business is responsible for confirming that it has authority and a legal basis to perform such deletion, including with respect to customer records, operational documentation, legal duties, and accounting or professional needs.

5. Availability, changes, and support

  • Zimun is provided on an as-is and as-available basis. We work to keep the platform reliable, but we do not guarantee uninterrupted, error-free, or loss-free operation.
  • Features may be updated, changed, limited, suspended, or discontinued to improve the product, protect security, comply with law, or maintain the platform.
  • Temporary downtime may occur because of maintenance, incidents, infrastructure issues, third-party providers, network failures, or events outside Zimun's reasonable control.
  • Support channels, response times, service levels, and paid plan commitments apply only if they are expressly stated in a separate written agreement or plan description.

6. Fees, paid plans, and suspension

  • If paid plans, invoices, usage fees, or subscription terms apply, they will be described in the relevant order form, plan page, invoice, or written agreement.
  • Fees are generally non-refundable unless a separate written agreement, mandatory law, or a specific product policy states otherwise.
  • Zimun may suspend or limit access if payment is overdue, if the business materially breaches these terms, if continued use creates security or legal risk, or if suspension is required by law.
  • Suspension does not remove the business's responsibility for customer communication, legal obligations, outstanding payments, or exporting data before termination where export is available.

7. Intellectual property and feedback

  • Zimun and its licensors own the platform, software, design, workflows, documentation, trademarks, and other intellectual property in the service.
  • The business retains ownership of its own business content and customer records, subject to the rights needed for Zimun to host, process, transmit, display, back up, secure, and operate that content as part of the service.
  • If you provide feedback, suggestions, or improvement ideas, Zimun may use them without restriction or compensation, while avoiding disclosure of confidential customer information.

8. Liability, indemnity, and governing law

  • To the maximum extent permitted by law, Zimun is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, including missed appointments, lost revenue, customer disputes, or business interruption.
  • The business is responsible for claims, complaints, fines, losses, or costs arising from its services, customer relationships, unlawful content, misuse of the platform, or failure to provide required privacy notices or consents.
  • The business agrees to defend and indemnify Zimun against third-party claims arising from the business's services, data, instructions, content, or breach of these terms, subject to applicable law.
  • Unless a separate written agreement states otherwise, these terms are governed by the laws of the State of Israel, and the competent courts in Israel will have jurisdiction.
